Terms of Use

Terms of Use. Welcome to Snipi. By visiting us at Snipi.com, and/or utilizing the Snipi Toolbar, mobile products and associated software developments as may be changed from time to time (herein, collectively called "Snipi Properties"),you accept these Terms of Use and acknowledge our policy on privacy as outlined on the Privacy Notice. Please read them carefully.

Copyright and Intellectual Property Policy. Content posted on the Snipi Properties by us is owned by us or used with permission. You may not copy, use or retransmit anything from, on, or for Snipi without our permission.

Infringers. Snipi respects the intellectual property of others and does not want to infringe on the valid proprietary rights of anyone. To that end, Snipi suggests that our users do the same. Snipi has no responsibility for content on other web sites that you may find or access when using Snipi's products or services. Material available on or through other web sites may be protected by copyright and the intellectual property laws of the United States and/or other countries. The Terms of Use of those web sites, and not the Snipi Terms of Use, govern your use of that material. You should read those terms carefully. If authorization to use the material from any other website is needed, it is your responsibility to contact the owner(s) of that material. Snipi will not be responsible for obtaining authorization for you or for any liability associated with your failure to obtain authorization.

It is Snipi's policy, in appropriate circumstances and at its sole discretion, to disable and/or terminate, with or without notice, the accounts of users who may infringe or repeatedly infringe the copyrights or other intellectual property rights of Snipi or others.

Notice for Claims of Intellectual Property Violations and Agent for Notice. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, please provide Snipi's Copyright Agent with the following information:

1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;

2. A description of the copyrighted work that you claim has been infringed upon;

3. A description of where the material that you claim is infringing is located on the site;

4. Your address, telephone number, and e-mail address;

5. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Policy on Repeated Infringer. Snipi respects the intellectual property rights of others and does not want our users to infringe on the valid proprietary rights of anyone using your user accounts and/or the Snipi Properties. Therefore, we reserve the rights to limit, suspend or terminate our service and user accounts, prohibit access to Snipi Properties, delay or remove hosted content, and take technical and legal steps to keep users from using the Snipi Properties if we believe that they are creating problems, possible legal liabilities, or otherwise infringing someone's intellectual property rights. For those users who have been identified as repeated infringers, we reserve the rights to suspend or terminate our service or their user accounts immediately with or without notice and without any refund of any user charges that may apply.

Permissions on Snipi's Intellectual Property. If you are seeking permission to use Snipi's intellectual property, including, without limitation, trademarks, logos, service marks, trade dress, slogans, screen shots, copyrighted designs, or other brand features, please contact Snipi's information desk by e-mailing info [at!]snipi [dot] com, not the Copyright Agent. Snipi reserves he right to approve or deny permission to use Snipi Intellectual Property in its sole discretion.

Policy on Privacy. Please review our Privacy Notice, which also governs your use of Snipi Properties, to understand our practices.

Electronic Communications. When you visit or use any of the Snipi Properties or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on Snipi's Properties. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Copyright. All content included on Snipi Properties, including, without limitation, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Snipi, its content suppliers, other copyright holders, or otherwise is used with permission, and protected by United States and international copyright laws. The compilation of all content on Snipi Properties is the exclusive property of Snipi and protected by the United States and international copyright laws. All software used on the Snipi Properties is the property of Snipi or its software suppliers and protected by United States and international copyright laws.

Trademarks. "Snipi", "Snipstream", "Snipi Toolbar", "Snipi.com", "SnipList", "Snippers" and all Snipi related words, marks, drawings, logos, names, and/or designs are trademarks, registered trademarks or trade dress of Snipi in the United States and/or other countries. Snipi's trademarks and trade dress may not be used in connection with any product or service that is not Snipi's, in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits Snipi. All other trademarks not owned by Snipi that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Snipi.

Patents. The Snipi Properties, including, but not limited to, the Snipi Toolbar, is also protected by one or more patents.

License and Site Access. Snipi grants you a limited license to access and make personal use of the Snipi Properties and not to download any material in violation of our or others' copyrights, or modify it or any portion of it in violation of our or others' copyrights, except with express written consent of Snipi and/or other copyright holders. This license does not include any resale or commercial use of this site or its contents; any collection and use of any images, videos, product listings, titles, tags, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

The Snipi Properties as a whole or any portion of the Snipi Properties may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Snipi. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Snipi without the express prior written consent from Snipi, which consent may be withheld in Snipi's sole discretion. You may not use any meta tags or any other "hidden text" utilizing the Snipi name or trademarks without the express written consent of Snipi. Any unauthorized use terminates the permission or license granted by Snipi.

Third Party Intellectual Property Rights. All third-party images, drawings, recordings, and text referenced, made accessible or made available to you on the Snipi Properties or by means of the Snipi service are protected by the copyright and/or trademark laws of the United States and other countries. You may need to obtain authorization of the owner of such materials before using them for any purpose other than viewing on the website. It is your responsibility to obtain any authorizations to use an image, drawing, recording, or text that may be required. Snipi accepts no responsibility or liability for the content of any images, drawings, recordings, or text included in the Snipi Properties or otherwise accessed using the Snipi service or for your use of such content. Snipi reserves the right to remove any materials or content with or without notice.

You are not permitted to post or distribute any material you do not own or which you do not have permission to use. You are prohibited from copying or distributing any copyrighted materials without proper permission from Snipi and/or other copyright holders using the Snipi service. You are also prohibited from using the Snipi service to interfere with the technological operation of the sites or that tampers with any copyright protection mechanisms applicable to content on any sites.

Your Account. When using the Snipi website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

Disclaimer of Warranties and Limitation of Liability. THE SNIPI PROPERTIES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE PROPERTIES ARE PROVIDED BY SNIPI ON AN "AS IS" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING. SNIPI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF ITS PROPERTIES OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS THESE PROPERTIES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THESE PROPERTIES IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, SNIPI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SNIPI DOES NOT WARRANT THAT THE PROPERTIES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE PROPERTIES; THEIR SERVERS, OR E-MAIL SENT FROM SNIPI ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SNIPI WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SNIPI PROPERTIES OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE PROPERTIES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

IN NO EVENT SHALL SNIPI BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SNIPI PROPERTIES.

Applicable Law. By visiting or using any of the Snipi Properties, you agree that the laws of the Commonwealth of Pennsylvania, without regard to principles of conflict of laws, will govern the Terms of Use and Policy Notice and any dispute that might arise between you and Snipi.

Disputes. Any dispute relating in any way to your visit to any Snipi property or to products or services sold or distributed by Snipi or through Snipi Properties shall be adjudicated in any state or federal court in Philadelphia County, Pennsylvania, and you consent to exclusive jurisdiction and venue in such courts.

Indemnity. You agree to indemnify and hold Snipi, its subsidiaries, and affiliates, and their respective officers, agents, partners, and employees, harmless from any loss or liability arising out of your use of the Snipi Properties or from any claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Snipi Properties in violation of these terms of service.

Privacy Policy

Privacy Notice. We care about your privacy. This Privacy Notice discloses our privacy policy, which tells you about how we use and protect user information.

Type of Information That Snipi May Collect. To provide our services to our users effectively, Snipi may collect certain user information. We use user information to understand what makes you different from our other users. In other words, we collect your information to understand your preferences and likes. Information collected by Snipi is usually defined as being either "anonymous" or "personally identifiable".

Anonymous information refers to data that cannot be tied back to a specific individual. For example, Snipi collects some information each time a visitor comes to the Snipi website so we can improve the overall quality of the visitor's online experience. Snipi collects the visitor's IP address, referral data, browser, browser path, and platform type. Much of the user's anonymous information is collected automatically using various technologies, including "cookies" (see below).

Personally identifiable information refers to data that tells us specifically who you are, such as your name or email address, which may be collected in addition to the anonymous data described above. Snipi collects personal information in the following ways from different parts of the Snipi Properties:

Snipi Registration: When you register to use the Snipi services, you provide Snipi with your personal identifying information, such as your name, contact information, and other descriptions about you personally.

Correspondence: If you contact Snipi, including via e-mail, we may keep a record of that correspondence.

Snipi reserves the right to collect certain information and store it in connection with your account. This information includes information about the different sites that you visit within the Snipi website as well as the time and frequency at which you visit them. This information also includes the content that you transmit or post to or on the Snipi Properties (as defined in our Terms of Use). Snipi Properties that reside and operate outside of the Snipi website and their specific collection activities include:

Snipi Toolbar: The Snipi toolbar also collects data about activities you engage in while specifically interacting with the Snipi toolbar. Your user ID, items collected, lists, and associated content and any comments, descriptions, or tags that are displayed on Snipi.com. Therefore this data is available to the public and will be identifiable to your user ID. You can choose to make you lists private by setting it to private when creating the list in the toolbar. Personally identifiable information is not shared by Snipi in any way. Anonymous data, including demographic information, and anonymous activity or browse paths may be used to help third parties personalize experiences to users. In no circumstance will Snipi share your real name, email address, phone number, mailing address or personally identifiable information you have provided to Snipi with third parties.

Snipi Mobile Applications: While using the Snipi mobile applications. Snipi may collect data about the location, list, and item a user has selected. As in all other circumstances, Snipi may use this data to improve the Snipi Properties, provide personalized services, or share anonymous user data with third parties. In no circumstance will Snipi share your real name, email address, phone number, mailing address or personally identifiable information you have provided to Snipi with third parties.

Identity of Organizations Collecting Your Information. When you register and use the Snipi service, user information is generally collected and maintained solely by Snipi unless specifically stated otherwise. Snipi at times may be sharing anonymous data with a third party company. Snipi allows you to use the Snipi services while you are on other websites other than Snipi.com. Anonymous data collected while you are on non-Snipi websites and only while using the Snipi service can be shared with third parties. The data Snipi shares with a third party company will be anonymous data with no personally identifiable information offered or transmitted by Snipi. You should be aware of other companies' websites and privacy policies while using the Snipi services in association with their websites.

Although Snipi only collects anonymous data while you are on other companies' websites, some of these third party websites may collect personally identifiable information from you. While Snipi hopes that all third parties involved adhere to our policies regarding the privacy of our users, the Snipi Privacy Policy does not cover third-party data collection practices and the Snipi Network does not assume any responsibility for any actions of third parties.

Identity of Organizations with Whom Snipi Shares the Collected Information. Information about Snipi users is important to us, and we are not in the business of selling personally identifiable information to third party companies. However, whenever you are using the Snipi service on other companies' websites, anonymous data collected may be shared with the third-party companies providing the service. Such anonymous data may be shared with third party websites to personalize user experience and/or improve their service. You should read the individual privacy policies of such third parties and make an informed decision on your own whether to continue based upon these sites' privacy practices and your own discretion.

In addition, Snipi may disclose information about individual users to third parties who agree to provide services to Snipi and who agree to maintain the confidentiality of such information in accordance with this Privacy Notice. These third parties will provide a variety of services to Snipi, including, without limitation, processing and storing user information, helping to create new content and promotions for the Snipi websites, and sending or coordinating the sending of marketing communications that users have consented to receive. Snipi shall not be responsible or liable if any of these third parties breach the terms of the Snipi Privacy Notice.

Snipi will disclose information about individual users to governmental or judicial authorities or law enforcement agencies, or to other individuals or entities in response to subpoena, court order, or other legal process.

If Snipi is acquired by or merged with another company, Snipi may transfer personally identifiable information about you to that company. Snipi will notify you in the event that your personally identifiable information is transferred under these circumstances and becomes subject to a different privacy policy.

Cookies. Snipi collects anonymous information passively using various technologies, including cookies. While Snipi collects information using various technologies, cookies play an important role in making the Internet work, and it is important you understand how they are used.

A cookie is a small text file containing a unique identification number that is transferred from a web site to the hard drive of your computer so that the site administrator may identify your computer and passively track its activities on the web site. This unique number identifies your web browser to our computer system whenever you visit one of the sites in the Snipi network. A cookie will not allow a web site to learn any personally identifiable information (such as your real name and address) that you have not otherwise disclosed. Cookies allow Snipi to remember automatically your web browser when you visit our websites. To help serve you better, Snipi generally uses cookies to deliver our products and services more efficiently. By storing certain registration and preference information on cookies or associating cookies with registration, preference or profile information stored on our computers, we can deliver products and services that use such information more quickly and efficiently for more users.

The use of cookies is an industry standard, and they are currently used on most major web sites. It is possible to adjust your web browser preferences to alert you when a cookie is sent to your hard drive, or to refuse cookies altogether. While Snipi does not require you to use cookies, keep in mind that certain sites and services will not function properly if you set your browser to refuse all cookies.

The Way in Which Snipi Uses the Information it Collects. Any personally identifiable information you share with Snipi when using the Snipi service is maintained and accessible only by Snipi unless specifically stated otherwise. Snipi requests information from its users so that users can enjoy customized experiences across the Snipi website, including personalization services, interactive communications, and much more. We can also better prepare future content based on your interests. We do not sell, rent or share any of your personally identifiable information to third parties for their marketing purposes. However, brands and retailers may send you in-system messages through the Snipi service. You may opt out of these messages at any time through your account preferences and your personal email address will never be shared.

If you send an email using the Snipi service to an email address that is not registered with Snipi, we will not use that email address for any purpose other than to send the message you intended to send that email address. We do not sell, rent or share these email addresses, nor do we send them additional emails.

On an aggregate, non-personally identifiable level we may also collect data to analyze site activity, usage, and improve content, layout, design and services, and for disclosure to third parties to demonstrate the value of the Snipi Properties.

Accessing or Editing Your Information. The Snipi websites provide its registered users the ability to access and edit the personal information in their user profiles. You can access your user profile by following these steps:

This area will allow you to edit your profile details.

Security Procedures in Place to Protect Your Information. The Snipi Properties have security measures in place to attempt to protect against the loss, misuse and alteration of your user data under our control. Snipi uses physical, electronic, and procedural safeguards to protect any personally identifiable data stored on its computers. Only authorized employees have access to the information you provide us. Credit card numbers used to purchase premium services, if and when applicable, are encrypted prior to transmission to protect your privacy and credit card information.

While we cannot guarantee that loss, misuse or alteration to data will not occur, we take many precautions to prevent such unfortunate occurrences. You are ultimately responsible for the security of your Snipi username and password. Please take care when using and storing them. Snipi recommends that you do not divulge your password to anyone. You should log out of your browser and/or log out of the Snipi service at the end of each computer session to ensure that others cannot access your personal information and correspondence, especially if several people have access to your personal computer or you are using a computer in a public place like a library.

Message to Parents for Persons Under the Age of 13. Snipi's Properties covered by this policy are not intended for the use by children, especially those under the age of 13. No one under the age of 13 is allowed to provide any personal information or use the public areas of any Snipi Properties.

If your children disclose information about themselves in any public area of the Snipi Properties, they may get unsolicited messages from other parties. Accordingly, you should restrict them and instruct them not to do so. We have required that all persons registering for Snipi's Properties indicate that they are at least 13 years of age. The circumvention of this mechanism is the sole responsibility of each child's parent and Snipi will not be held liable for those individuals who provide misleading or inaccurate information.

If you're concerned about your child's activities or their privacy on the Snipi Properties, we encourage you to send an email to Snipi at support [at!]snipi [dot.] com.

Location of Stored Personally Identifiable Information. Personally identifiable information collected by Snipi may be stored and processed in the United States or any other country in which Snipi or its agents maintain facilities. By using the Snipi Properties, you consent to any such transfer of information outside of your country.

Conditions of Use, Notice, and Change of Policy. If you choose to visit or use any of the Snipi Properties, your visit and any dispute over privacy is subject to this Privacy Notice and the Terms of Use. As our business changes, our Privacy Notice or the Terms of Use may also change. When we make changes to our Privacy Notice or the Terms of Use, we may do so without notice. You should therefore check the Snipi website frequently to see any changes. You agree to be bound by both the Privacy Notice and Terms of Use as both may change from time to time.
